The video you are about to see is from a body-worn camera worn by Patrol Deputy Aguayo who is a Crisis Negotiator and is certified in crisis intervention.  This footage and audio capture the entire incident from when deputies arrived on scene, the active shooting by the suspect, and the shots fired by law enforcement.  Although not captured on the footage, there were multiple units on scene to include deputies, medical and fire personnel, and SWAT performing a variety of duties to ensure the community remained safe during this volatile situation.

In accordance with the statutory justifications outline by Colorado Law at C.R.S., 18-1-707 et. seq, a member is justified in using deadly physical force in the following circumstances:

a.  To defend the member or a third person from what is reasonably believed to be the use or imminent use of deadly physical force.

b.  To effect an arrest, or to prevent the escape from custody, of a person whom the member reasonably believes:

     •  Has committed or attempted to commit a felony involving the use of a deadly weapon; or is attempting to escape by the use of a deadly weapon and the suspect presents an imminent danger to human life or threat of serious bodily injury to another.

     •  Otherwise indicates, except through a motor vehicle violation, that the suspect presents an imminent danger to human life or threat of serious bodily injury to another unless apprehended without delay.
